Taiwan Amends the Toxic Chemical Substance Operators Liability Insurance Measures

Taiwan amended the Toxic Chemical Substances Operation Liability Insurance Measures and renamed it the Toxic and Concerned Chemical Substance Operators Liability Insurance Measures.

The Measures require operators to obtain liability insurance before operation if the total amount during the manufacture, use, storage, and transportation of toxic chemicals of the first to third categories or hazardous chemical substances of concern reach a specified benchmark.

Consultation Sought on EU Amendment of POPs Regulation for Entry of PFOS

The European Union issued Draft Commission Delegated Regulation (EU) amending Annex I to Regulation (EU) 2019/1021 of the European Parliament and of the Council as regards the entry for perfluorooctane sulfonic acid and its derivatives (PFOS). ​The Conference of the Parties decided to amend the acceptable purpose for the use of PFOS, its salts and PFOSF for metal plating (hard metal plating) only in closed-loop systems to a specific exemption. To reflect this decision, the Draft amends Part A of Annex I to Regulation (EU) 2019/1021 for PFOS.
 
The effect of the amendment allows Parties to use the referenced exemption for a maximum period of five years after the entry into force date. The exemption may be extended for additional five years following a decision by the Conference of the Parties, upon request by a Party, and based on a justification of the continuing need for that use. The Draft Regulation would enter into force on the twentieth day following that of its publication. The feedback period ended December 27, 2019.

India Issues Environment Protection Amendment Rules

India issued the Environment (Protection) Second Amendment Rules 2019 which added the effluent standard for automobile service stations, bus depots, and workshops, including the limits of dissolved phosphates, zinc, and metal, and the requirements for any solid or hazardous waste.

​The rules went into effect on the date of their publication in the Official Gazette. There is no additional information available at this time.

Australia Issues Consequential Amendments and Transitional Provisions for Industrial Chemicals

Australia issued the Industrial Chemicals (Consequential Amendments and Transitional Provisions) Rules 2019. The effect of the instrument ensures transition for regulation of industrial chemicals, from the old scheme (NICNAS) to the new scheme (AICIS), in relation to the recognition and transition of the following:
​
  • Assessment certificates;
  • Commercial evaluation permits;
  • Low volume permits;
  • Controlled use permits;
  • Early introduction permits;
  • Introductions under section 21 of the old scheme;
  • Assessment of priority existing chemicals;
  • Secondary notification;
  • Application fees, information, reporting and confidentiality; and
  • Matters relating to inventory listings.
 
This instrument takes effect immediately after the commencement of Schedule 1 to the Industrial Chemicals (Consequential Amendments and Transitional Provisions) Act 2019.

The EU Opened Feedback Period on Chemical Regulation Amendments

The European Union opened a feedback period from September 9, 2019 until October 10, 2019 on amendments to the REACH Regulation. Under the European Union’s REACH regulation, hazardous chemicals manufactured in the EU or imported must be accompanied by a safety data sheet.

The amendments will align the data sheets with new United Nations requirements and requirements for nanomaterials and clarify certain aspects on information issued by poison centers.

Hungary Issues Decree for Supervision of Storage Tanks and Facilities for Hazardous Liquids or Melts

Hungary issued a Government Decree 216/2019. (IX. 5.) on technical and regulatory supervision of storage tanks and storage facilities for hazardous liquids or melts.

​The Decree establishes requirements for the refueling of different sized storage tanks, on-site assembly and installation, commissioning, repair, conversion, inspection, periodic inspection, and decommissioning of storage tanks with a certain nominal volume to extend its service life and to suspend its operation. The Decree enters into enforcement on the 60th day following publication.

Germany published a guidance document titled, Safe Recovery and Disposal of Wastes Containing Nanomaterials on August 1, 2019. The document provides guidance on aspects of good product stewardship related to nanomaterials. It discusses the legal framework, conclusions from regulatory requirements, and the safe recovery or disposal of wastes containing nanomaterials. The guidance can be downloaded at the link below.

India Issues Draft Rules Regarding Lead

In September 2019, India issued G.S.R. 651(E) – Draft Rules – Lead Stabilizer Polyvinyl Chloride (PVC) Pipes and Fittings Rule 2019.

​This rule required that every manufacturer comply with the limits of the lead extraction and marketing requirements, such as ensuring durability and legibility of the embossment up to the life of the PVC pipes and fittings. The rules went into effect on the day of their publication in the Official Gazette.
